Meeting Procedure Local Law
Monash City Council ("Council") at its meeting on 18 December 2007 resolved to make a Local Law known as "Local Law No. 1 Meeting Procedures".
Purpose of the Proposed Local Law
The principal objective of the Proposed Local Law is to provide for the orderly, fair and effective conduct of meetings of Council and its Special Committees, and to provide for the election of the Mayor and Acting Chairpersons.
General purport of the Proposed Local Law
The Local Law:- revokes Council's existing Local Law No. 1 Meeting Procedures, made in 1998;
- requires the Mayor, once elected, to chair all Council meetings at which he or she is present;
- regulates the procedure for any Deputy Mayor or others to become Acting Chairperson in the Mayor's absence;
- regulates the proceedings of Ordinary and Special Meetings of Council, including the quorum required and the distribution of agendas;
- regulates what business can be transacted at meetings of Council, and in what order;
- regulates the time limit for Council meetings;
- regulates the passing and withdrawal of a motion (including notice of motion) or amendment;
- provide for the conduct of debates, and the taking and resolution of points of order;
- regulate the rescission or alteration of a previous resolution of Council;
- regulates the procedure for and effect of procedural motions;
- regulates the procedure for voting at Council meetings;
- creates an offence for a person who is guilty of any improper or disorderly conduct at a meeting not to leave the Council Chamber when requested by the Chairperson to do so;
- creates an offence for a person to fail to comply with a direction of the Chairperson in relation to the conduct of the meeting and the maintenance of order at that meeting;
- creates an offence for a person to operate audio tape or other recording equipment at a Council meeting without first obtaining consent;
- provides for the removal from the Council Chamber of any person who commits an offence;
- applies to meetings of Special Committee, with all necessary adaptations;
- regulates the procedure for the election of the Mayor; and
- provides for the service of infringement notices on those who commit an offence.
