Notice of Intention to Enter into Recreation Leases

For Tennis and Lawn Bowls Facilites, Waverley Netball Centre, Waverley Basketball Centre, Waverley Gymnastics Facility and Waverley Hockey Facility

Monash City Council ("Council") gives notice under Section 190 of the Local Government Act1989 ("the Act") that it proposes to grant leases to the following Associations and Clubs ("the proposal"):-
  1. Waverley Night Netball Association Inc. "Waverley Netball" for part of the parcel of land that comprises the Waverley Women's Sports Centre, 2/30 Jells Rd, Wheelers Hill;
  2. Waverley Basketball Association Inc. "Waverley Basketball" for part of the parcel of land comprised within Batesford Reserve at 94 Batesford Rd, Chadstone;
  3. Waverley Advanced Gymnastics Club Inc. "Waverley Gymnastics" for the part of the parcel of land located at 7 Dorrington Drive, Mt Waverley;
  4. The Waverley Hockey Club Inc. "Waverley Hockey" for part of the parcel of land comprised within Ashwood Reserve located at 106 High St Rd, Ashwood;
  5. Bayview Tennis Club (Chadstone) Inc. for part of the parcel of land comprised within Jordan Reserve, 313 Huntingdale Rd, Chadstone;
  6. Essex Heights Tennis Club Inc. for part of the parcel of land comprised within Federal Reserve, 2 Federal St, Mt Waverley;
  7. Gladeswood Reserve Tennis Club Inc. for part of the parcel of land comprised within Gladeswood Reserve, 24 - 56 Maygrove Way, Mulgrave;
  8. Glen Waverley Tennis Club Inc. for part of the parcel of land that comprises the Monash Aquatic and Recreation Centre, 3 Aquatic Place, Glen Waverley;
  9. Glenburn Tennis Club Inc. for part of the parcel of land comprised within Glen Waverley North Reserve, 5 Mulgrave St, Glen Waverley;
  10. Glenvale Tennis Club Inc. for part of the parcel of land that comprises the Glen Waverley Public Golf Course, 96 Shepherd Rd, Glen Waverley;
  11. Legend Park Tennis Club Inc. for part of the parcel of land comprised within Capital Reserve, 85 - 95 Capital Ave, Glen Waverley;
  12. Lum Reserve Tennis Club Inc. for part of the parcel of land comprised within Lum Reserve, 231 - 259 Lum Rd, Wheelers Hill;
  13. M.P.Tennis Club Inc. (Mayfield Park Tennis Club) for part of the parcel of land comprised within Mayfield Park Reserve, 34 - 38 Mayfield Drive, Mt Waverley;
  14. Mt Waverley Tennis Club Inc. for part of the parcel of land comprised within Mt Waverley Reserve, 8 - 26 Charles St, Mt Waverley;
  15. North Oakleigh Tennis Club Inc. for the part of the parcel of land located at 14 - 16 Atkinson St, Chadstone;
  16. Notting Hill / Pinewood Tennis Club Inc. for the part of the parcel of land located at 1-9 Baker Ave, Glen Waverley;
  17. Tally Ho Tennis Club Inc. for part of the parcel of land comprised within Tally Ho Reserve, 42 Bennet Ave, Mt Waverley;
  18. Wellington Tennis Club Inc. for part of the parcel of land comprised within Southern Reverse 161 - 181 Police Rd, Mulgrave;
  19. Wheelers Hill Tennis Club Inc. for the part of the parcel of land located at 65 - 73 Jells Rd, Wheelers Hill;
  20. Glen Waverley Bowls Club Inc. for part of the parcel of land comprised within Central Reserve, 690 Waverley Rd, Glen Waverley;
  21. Mt Waverley Bowling Club Inc. for the part of the parcel of land located at 6 Alvie Rd, Mt Waverley;
  22. South Oakleigh Bowling Club Inc. for part of the parcel of land comprised within Scammel Reserve, 1216 North Rd, Oakleigh
The proposed essential terms of each Lease are as follows:-
Rental:
Waverley Netball and Waverley Basketball for the sum of $2 per annum (plus GST);
Waverley Gymnastics for the sum of $7,417.60 per annum (plus GST);
The Waverley Hockey for the sum of $850 per annum (plus GST);
Bayview Tennis Club (Chadstone) for the sum of $560 per annum (plus GST);
Essex Heights Tennis Club for the sum of $630 per annum (plus GST);
Gladeswood Reserve Tennis Club for the sum of $490 per annum (plus GST);
Glen Waverley Tennis Club for the sum of $630 per annum (plus GST)
Glenburn Tennis Club Inc for the sum of $630 per annum (plus GST)
Glenvale Tennis Club for the sum of $630 per annum (plus GST)
Legend Park Tennis Club for the sum of $630 per annum (plus GST)
Lum Reserve Tennis Club for the sum of $630 per annum (plus GST)
M.P.Tennis Club Inc (Mayfield Park Tennis Club) for the sum of $630 per annum (plus GST)
Mt Waverley Tennis Club for the sum of $490 per annum (plus GST)
North Oakleigh Tennis Club for the sum of $420 per annum (plus GST)
Notting Hill / Pinewood Tennis Club for the sum of $910 per annum (plus GST)
Tally Ho Tennis Club for the sum of $630 per annum (plus GST)
Wellington Tennis Club for the sum of $630 per annum (plus GST)
Wheelers Hill Tennis Club for the sum of $630 per annum (plus GST)
Glen Waverley Bowls Club for the sum of $1,250 per annum (plus GST)
Mt Waverley Bowling Club for the sum of $780 per annum (plus GST)
South Oakleigh Bowling Club for the sum of $795 per annum (plus GST)
Payment:
Payable in lump sum upon the anniversary of the commencement date of the lease.
Rental Review:
To be reviewed annually in accordance with Council's Fees and Charges Policy.
Term:
15 years [with no option].
Permitted Use:
The organising of competitions, training and other activities directly associated with the sport undertaken on the premises.

Plans of the land proposed to be leased to the above Associations and Clubs are available for inspection at the Civic Centre.

Any person may make a submission on the proposal. All submissions will be considered in accordance with section 223 of the Act. Any person proposing to make a submission under section 223 of the Act must do so until 29 of August 2006.

Persons making such written submissions may also request to be heard by Council in support of their submissions. Any person requesting to be heard is entitled to appear in person or by a person acting on their behalf before a meeting of the Committee of Council comprising four Councillors, which hearing date has been set down for Tuesday 12 September, 2006 at 7.30 pm at the Civic Centre [unless otherwise advised].

Following consideration of submissions, Council may resolve to lease the land as detailed above or not to proceed with the proposal.
