Residential redevelopment is proposed on five former school sites in Monash.
In 2014, the former State Government sold these sites, after rezoning them from Public Use to Residential. The government received $97million from these sales. Council called for these funds to be reinvested in Monash: State reaps $97 million from sale of schools
The government placed a Development Plan Overlay on each of the sites, which took away the appeal rights of nearby residents. For this reason, Council asked the government to remove the Development Plan Overlays, but this did not happen. Update - June 2016
At its 28 June 2016 meeting, Council approved a Planning Application for this site.
The Development Plan provides for:
- A total of 26 townhouses (two and three storey)
- A two-four storey apartment building within the centre of the site, providing a total of 129 apartments.

At its 27 October 2015 meeting, Council approved a Development Plan for this site.
The Development Plan provided for:
- A total of 28 townhouses (two and three storey)
- A two-four storey apartment building within the centre of the site, providing a total of 122 apartments.
Council approved the submitted Development Plan, subject to the following changes being made:
- The Development Plan providing for retention of all vegetation rated as 'moderate' or 'high' (in a 2013 Tree Logic Assessment)
- The Landscape Plan amended to detail retention of significant vegetation rated as 'moderate' or 'high' (in a 2013 Tree Logic Assessment)
- Provision of an acoustic fence along the common boundary with 118-122 Wellington Road to attenuate noise impact from the adjoining church.

Update - Supreme Court challenge
The developer of the former Clayton West Primary School site appealed to the Supreme Court in a bid to progress its plans for a major housing development on the site.
The developer appealed after the Victorian Civil and Administrative Tribunal (VCAT) ruled that 32 mature trees could not be removed from the Alvina St site.
VCAT ruled that the developer's plan for tree removal didn’t comply with the site's Development Plan Overlay, as the overlay requires a landscaping plan that incorporates significant vegetation including any moderate and high value trees.
Council engaged a barrister to represent Council and community views at the Supreme Court hearing on 19 August 2016.
On 20 December 2016, the Supreme Court handed down its decision:

Unfortunately, the court ordered that the Development Plan Overlay be interpreted to mean that not all moderate and high value trees are required to be shown as retained on the Development Plan.
The court found that the wording of the Development Plan Overlay requires the developer to consider what significant vegetation is to be retained on the site under a proposed Development Plan, but does not require all moderate and high value trees to be specifically retained.
