Commercial Bin Services – Terms and Conditions
The following Terms and Conditions apply to commercial properties receiving waste and recycling collection services from Council.
1. Prohibited Materials
- Hazardous materials including but not limited to batteries, e‑waste, chemicals, flammable liquids, and medical waste must not be disposed of in any Council-supplied bin.
- Council reserves the right to refuse collection where hazardous or unsafe materials are identified.
2. Fees and Charges
- Service fees are reviewed annually and are subject to change from 1 July each year.
- Fees will continue to be charged until the date Council receives cancellation advice and the bin is removed from the property.
- Payment for services, including additional services, is required by the due date listed on the rates notice. Failure to pay by the due date may result in suspension or removal of services.
3. Bin Presentation and Collection
- Council-supplied bins will be collected from the kerbside or the nominated collection point for the property.
- Bins from non‑Council sources will not be serviced.
- All bins must:
- Be presented by 5:00am on collection day.
- Be removed from the collection point within 24 hours after collection.
- Not exceed a maximum gross weight of 72kg, with the lid fully closed.
4. Bin Condition and Maintenance
- The occupier must keep all bins in a clean and hygienic condition and is responsible for cleaning up any spillage or litter resulting from overfilling or incorrect use.
- Council will repair or replace bins at no cost if they are damaged accidentally or stolen.
- If bins are damaged or lost due to misuse, neglect, overloading, or failure to secure the bins on-site, Council may charge the property owner for repair or replacement.
5. Construction Sites
- Properties under construction must contact Council to arrange bin removal during the construction period to prevent misuse or theft.
- Bins will be re‑issued only once construction is complete and the property is occupied.
6. Waste Management Plans
- Where a Waste Management Plan (WMP) has been approved for the property, Council will supply services strictly in accordance with that plan.
- Additional bins or services may not be available where they conflict with the approved WMP.
7. Maximum Service Provision (from 1 July 2026)
A maximum of:
- 2 × 240L Garbage bins
- 2 × 240L Recycling bins
- 2 × 240L FOGO bins
may be provided unless otherwise permitted under an approved Waste Management Plan.
8. Food Organics and Garden Organics (FOGO) Services
- Commercial properties must apply for a FOGO service by emailing mail@monash.vic.gov.au.
- Council will assess each application and may refuse service where contamination risk or infrastructure constraints are unacceptable.
9. Audits and Inspections
- Council or its contractors may undertake bin audits, which may include:
- Visual inspection of contents
- Contamination assessment
- Verification of bin serial numbers
- Inspection of bin condition
- By using the service, commercial customers consent to these inspections.
10. Contamination and Non‑Compliance
- Bins are subject to Council’s bin inspection program.
- Bins containing unacceptable materials will not be collected.
- Upon notification, the customer must remove all contaminants before a re‑collection can be arranged.
- Council will provide education and support; however, repeated contamination may result in:
- Suspension of service
- Cancellation of service
- Additional fees or enforcement action, as applicable
