We are following up on our story today regarding Merri-bek Council, which discovered it had been improperly overcharging for certain parking fines for a decade because it had never passed the required council resolution.

Does your council currently, or has it previously, charged a penalty rate above the 0.2 penalty unit base level for any of these 11 infringement types?

If so, can you confirm that a formal council resolution is in place to legally authorise this higher rate?

In light of the issue at Merri-bek, are you now undertaking a review to confirm your council's penalty rates are compliant?

Response

Monash has applied penalty rates above the 0.2 penalty unit base. This has been authorised by Council resolution. We regularly review our processes to ensure compliance with legislation. We’ll continue to monitor and review penalty rate practices as required.
