Amended Plans - June 2025

The applicant has lodged an amendment directly with the Victorian Civil and Administrative Tribunal (VCAT) under Section 87(2)(a) to amend the development to include the use of a short-stay residential hotel, reduce the number of residential apartments, relocate car parking from basement to level 1, reduce the total number of car parking spaces, amend the building design and increase the building height.

VCAT Approval - December 2022

Council is disappointed with VCAT’s decision to grant a planning permit for the proposed development.

As no question of law exists which would allow further appeal to a higher jurisdiction, this decision cannot be appealed.

VCAT Amended Plans - October 2022

Amended plans were circulated as part of the developer's appeal to the Victorian Civil and Administrative Tribunal (VCAT) on a proposal at 1041 Centre Road, Oakleigh South.

These plans will be considered at the VCAT hearing. 

The key changes in the amended plans are:

  • Introduction of a proposed pedestrian footpath along the eastern boundary linking the proposed development with the existing shopping precinct
  • Re-orientation of residential levels
  • Redesign of basement layouts
  • Relocation of proposed retail tenancies and supermarket
  • Reposition of the substation
  • Updated link to footpath at the northwest of the proposed development
  • Additional proposed landscaping zone along Centre Road and pathway from Centre Road to the street front retail tenancies
  • Proposed level 06 rooftop amenities for residents
  • Relocation of residential rooftop amenities to lower levels
  • Updates of elevational treatment revision and materials
  • Residential floor to floor height reduced from 3.2 to 3.05m
  • Ground to podium level reduced in height from 6.4 to 5.9m
  • Reduction of overall building height by 6.7m to a maximum of 24.2m
  • Updates of general apartment layouts and introduction of a 3-bedroom dwelling.

Council’s position on this amended proposal remains unchanged. Council will argue against the proposed development plan at the VCAT hearing.

Refusal and VCAT appeal - June 2022

In June 2022, Council refused an application for the development of a 9-storey high building to be used as supermarket, retail premises, food and drink premises and Build-to-Rent apartments at 1041 Centre Road, Oakleigh South.

Council sought community feedback on the proposal and received 69 objections.

The applicant has appealed to the Victorian Civil and Administrative Tribunal (VCAT) against Council's decision.  

Original application - 2022

Council sought community feedback in 2022 on the proposed development of a 9-storey mixed-use building at 1041 Centre Road, Oakleigh South (The Links Shopping Centre).

The applicant, Pellicano Group, proposed a $49 million development that comprised:

  • A 9-storey building with maximum building height of 33.8m.
  • A total of 173 Build-to-Rent apartments including 7 studios, 112 x 1-bedroom and 54 x 2-bedroom apartments.
  • Supermarket of 1,913m2.
  • Retail premises of 875m2.
  • Food and drink premises of 88.1m2.
  • A total of 212 bicycle parking spaces provided within the site, satisfying the statutory requirement.
  • A total of 238 car parking spaces provided within the basement and on ground level. The proposal generates a statutory car parking requirement of 298 spaces and 238 spaces are provided on site. The proposal seeks a reduction of 60 car parking spaces for the commercial component.

Build-to-Rent Meaning:
